Court Enters a Take Nothing Judgment in Favor of GWA Clients and Co-Defendants
In December 2021, Gregor Wynne Arney partners Lance Arney and Tom Gregor participated in a week-long, in-person jury trial in Harris County District Court. Their clients were two members of a limited liability company that owned and operated an RV park. The clients were being sued by another member in the company who was seeking more than $1 million in compensatory damages, plus exemplary damages.
The case had been filed in 2019 and was unusually complicated, with seven different parties represented by four different law firms, asserting claims, cross-claims, and third-party claims with multiple causes of action and defenses. The final jury charge was 34 pages long and included 20 questions.
The Court dismissed one cause of action during trial, upon GWA’s motion. Following trial, the jury returned a verdict in favor of GWA’s clients, finding no liability on one cause of action and finding that an affirmative defense applied to another claim.
The verdict resulted in extensive post-trial briefing and argument. On June 21, the Court entered a final judgment that the plaintiff take nothing against GWA’s clients and their co-defendants. The Court also entered declaratory relief as requested by GWA and awarded GWA’s clients $165,555 in attorneys’ fees for the trial, as well as post-judgment interest.
