In An Important Win For Attorney Lance Arney And His Client, Texas First Court of Appeals Issues Unanimous Opinion Confirming Trial Court’s Take-Nothing Judgement
Lance C. Arney, a partner with Gregor Wynne Arney, PLLC, won an important appellate victory on behalf of firm clients Judston F. Welling and Jonathan D. Gibbs in the Texas First Court of Appeals.
The case involved a dispute over the transfer of membership interests in a Texas limited liability company that owned various RV parks throughout Texas. Also in dispute were the trial court awarded attorneys’ fees.
On June 24, 2025, the Court issued a unanimous opinion, authored by Justice David Gunn, affirming the trial court’s take-nothing judgment against the firm’s clients and affirming the trial court’s declaratory judgment in their favor. The judgment also affirmed the trial court’s award of $198,055 in attorneys’ fees to the firm’s clients against Defendant Community RV Investments, LLC (subject to any further petition for review to the Texas Supreme Court).
Mr. Arney served as lead trial and appellate counsel for Messrs. Welling and Gibbs, and was joined by Thomas M. Gregor, also a partner in the firm, in presenting the case at trial.
The case has been pending since 2019. Mr. Arney commented, “We are pleased that the court of appeals affirmed the trial court’s take-nothing judgment in our clients’ favor and that our deserving clients are a step closer to obtaining justice and recovering their attorneys’ fees.”
